View Full Version : It Never Ends... Landlord Wants To Replace The Windows In The Middle Of Winter...

Ok, I told the landlord back in October that I'd be out by the end of November, because at the time I was in contract on a house that I was supposed to close on in early November. That deal went south, and I'm still in the rental. The landlord set up some contractor work expecting me to be out, and never adjusted the timeframe when I didn't move, and now tells me this morning that he's expecting the contractors to be doing the work at the end of the month, or in early January.
They're expecting me to deal with this in the middle of winter, not to mention the fact that I live on the opposite side of the clock, as we work nights and sleep days. So I won't have windows, or sleep, in the middle of winter.
Have I got any standing to tell them to feck off with this shit? The house is tight right now, it's not like the windows need to be done right this minute because of damage or anything, so they can't say that.
I'm furious because we've never been late with the rent, not once in 11 years and we've only called them to fix shit maybe three times in that time... not a perfect tenant by any stretch, but I do feel like we've earned a little consideration... especially when I look back over the rent ledger and see what we've paid them to live here over that 11 years...

Since you changed your mind about moving out and the landlord has let you stay on what I assume is a month to month arrangement at this point, do you really think is is wise to tell him to feck off?

I didn't exactly change my mind, I was forced into this situation. I'm working to get out of his place as fast as I can. I don't need him ripping the place apart in the middle of winter, while I'm trying to find a house and move and all the work has to be done while the wife is supposed to be asleep.

I would try reasoning with him before I told him to f'ck off. Bottom line is that the deal on the house turning south is your turn of bad luck, not his. He may or may not have commitments with the contractor. So it might be advantageous to be a bit amiable with him.

I think you should feel lucky to still have a place to live. He could have re-rented or sold the place, but instead is giving you a month by month arrangement. Professional window installers are very fast.....you won't even notice them, in and out in a day or two max. Put up with it, and consider yourself lucky. IMHO! :thumbs:

The house will be "uninhabitable" and if this is the case, by law, you are not subject to paying the rent.

If you mention the word "uninhabitable" and the landlord knows the laws, he'll change his tune with the quickness.
I had a tenant who broke windows and claimed uninhabitability. After the second window, I knew it was a pro , so I gave them 30 day notice of eviction at month end. Upon suing them for rent, the judge ruled for them, as the place was uninhabitable, even though they were still residing there.
Another avenue is to not let the contractors into the house. This work is not vital to the proper operation of the house, so you don't have to let them in if you so choose.
The best way to handle it is to ask the landlord nicely to postpone the work until it warms up or better yet, until you are out of there.
Who pays for the heat there?
By the way, that job shouldn't take more than one day for actual window replacements. The real time involved will be the trim in & out and finishing, which is inconvenient for you, but the interior won't be exposed to the elements.
The openings are not open as long as you might think.

A month to month renter has a same rights as a leased renter.

I'd be very careful with this "feck off with this shit" attitude until you have a serious talk with you landlord, letting him know why you haven't quit the property as you'd planned to.
Push too hard and he might decide the place also needs carpet, painting, plumbing and all manner of things done now, and your problems are just that, your problems.
A bit of contriteness can serve you well.

I agree, I'd ask how long it is supposed to take and go to a hotel for a couple of days. Like was said, window installers are fast, so take a break to a hotel and call it good as depending on how things go you may need his cooperation again

Yeah. I'd try reasoning with him first. If no joy, then go to a hotel for the couple days it will take. You also may want to make friends with the contractor, and get a solid committment to get it done as quickly as possible. A little baksheesh may help.

Sure, but the landlord could have told you to feck off instead of letting you continue to rent his place. Your being forced into a situation doesn't obligate the landlord to continue to rent to you.

All a landlod has to to , lease or not, is give 30 day notice to get rid of someone. The 30 days starts from the first day of the next month.
In my experience, leases are weighted heavily in favor of the landlord and usually have a 30 day clause that precedes the leases time frame.
As a landlord, I would always have a friend serve the 30 day notice on the last business day of the month. That way, I had a witness and there was 30 days, and ONLY a full 30 days to get out.
Like I said, 30 days begins on the 1st day of the next month. Give it on the second of the month and you just gave the person 2 months and possibly a free month of not paying rent.
In Apex's case, I would think that the landlord would want his money for as long as Apex wants to stay and will not evict him unless he becomes a "liability.

I'm very transparent with him. He's known what's been up every moment of every step of the way. He knew the contract fell apart on both houses practically before my wife did.
And relax guys, when I mentioned telling him to feck off, I was asking about nuclear options, once the diplomatic path has been explored.
The wife and I are going to ask if they'll pro-rate the rent, so we can just get a hotel while the work is being done. I just don't need the unholy f*cking hassle at this moment in my life. I'm still not 100% health-wise, I'm busting my hump as it is trying to find a new place to live, I've been packed to move for months, but do you think the wife has stuck so much as a book in a box? Sure she has, and then she's decided that box was better suited for plates. I had a full head of hair in August, I'm half bald now and not one hair of it has fallen out. It's all been ripped out, clump, by clump.

You didn't put his daughter through college; he did. By using the proceeds from renting you a house that HE invested in, HE paid for, HE insured, HE maintained, etc.
And the consideration you received was living in the aforesaid house.
I've been both a renter & a landlord, and understood my standing in both situations. Being upset because he's going to improve his house by replacing some windows & disturb your sleep in the process is unreasonable, IMO.
One of my tenants was without water while I had a well pump replaced. They said that they were entitled to a rent rebate for the day due to "uninhabitability". I agreed, but suggested that we let a judge make the final determination. That was the end of that, although I would have gladly refunded them a day's rent, HAD THEY NOT STAYED IN THE HOUSE.

The wife works nights, 7pm to 7am, and I share her schedule, otherwise, I'd never get to see her.

I'm under a lot of pressure at the moment. I'm trying to get out of this house for them, I've had two houses I've tried to buy fall out through no fault of my own, at every turn I'm being lied to by realtors (not mine), inspectors (not mine), I just blew $2,300 on the car when I could have been quite happy not doing that, I'm in a fight to get a surgery that my doctors are telling me I need, so that my own legs stop trying to kill me, but the insurance company keeps telling me I only want so I'll look good in a thong, I'm at the doctors office every week, having blood drawn, and I'm so needle phobic that I have to be restrained and sedated if they come at me with anything sharper than a ballpoint pen so I don't reach out and rip the nuts off some poor orderly again, so I spend most of my time in a debilitating anxiety attack about my next doctor's visit because all I can think about is a stupid f*cking needle prick that isn't going to hurt anyway, but my traitorous body won't let me just deal...
I've been at 9000rpm and 150mph for over a year now with no break and none in sight and I'm just over it all.

There is not one inch to move in this place. I just don't have the space to move around. So now I have to move, before I can move. I have to just put my shit in storage and halfway move out now. That's just what has to be done.

Yeah, the hoarder comment was a joke really. Things are tight, but give me a few days and I'll get stuff in storage and we'll be able to get them access to the windows to measure and install.
I would just have a much different view of the situation if I had been given even just a week more lead time, you know? He set this up with the contractor in October. Told me yesterday. I could have been so much better prepared for this, had he given us the heads up.

If you can negotiate a better time for you both that would be great. If not, it's not really a big deal.
I've had multiple properties we've done complete window replacements on. I usually try to time it between rentals but can't always do so.
Hell, I had a crew replace all the windows in the last house I was in in the middle of a snowy Winter. They suck in NE PA...
Guys did a couple dozen windows in 6 hours. I went behind them and stuffed each sash with insulation which REALLY helped the drafts in that older home.
I used one of my job site heaters to break the chill while they were out. (200,000 BTU kero rig that looks more like an afterburner)

Look at the bright side, you're only blocking one lane at a time now.
Moving absolutely sucks. There's no way around that. Personally, I don't move shit that hasn't been touched in over 6 months...it gets tossed or donated (collectible or sentimental shit excluded, of course). If the SO is favorable to that, or any reasonable timeframe, start tossing shit. You'll make room now and make moving easier later.

I don't know how long it will take. They haven't even measured yet. He just tells me yesterday "I'm having the windows replaced. They'll need to be able to get at the windows, inside and out. They'll be here end of the month or first of January."
His wife was the one that told us they had set this up with the contractor in October.
I get why they didn't tell us in October, it's none of our business what they do with their house after we move out, but once they knew we'd still be in it, they should have given us the heads up and let us prepare for this, instead of dropping it on our heads, during the holidays, when we're already dealing with trying to find a new home and move.
